This writ petition is filed under Article 226 of the Constitution of India, seeking to issue writ of mandamus directing the respondents to grant 3 additional increments to the petitioners as personal pay for having graduate qualification from the date of possessing graduation with all consequential benefits including arrears of pay. 2.

When the matter is taken up for hearing, it is noticed that the petitioners were appointed as employees of APSRTC during 1990. The issue whether the persons who are eligible for graduation increment are to be extended to the APSRTC employees or not was considered in I.D.No.38 of 2001, wherein the Industrial Tribunal, vide orders, dated 23.03.2007, has considered the entire issue and held that the Conductors/Booking clerks recruited with Graduation qualification on or after 24.04.1982 are not eligible for additional increments i.e., graduation increments. Since the petitioners were recruited during 1990, they are not entitled for additional increments for possessing graduation qualification.

In view of the same, the writ petition is liable to be dismissed and accordingly, the same is dismissed. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
