HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13481 of 2015 ORDER:

This petition is filed by the petitioner - Accused under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail to him in M.C.No.79 of 2015 on the file of the Executive Magistrate at Hasanparthy, Warangal District.

On 9.9.2015, the petitioner entered into a bond of security for good behaviour for a period of six months and in default, to forfeit a sum of Rs.1,00,000/- to the Government. Subsequently, he committed the offence punishable under Sections 7(A) r/w 8(e) of the Prohibition Act in a case in Crime No.777 of 2015-16 of Prohibition and Excise Police Station, Hanumakonda.

Then, the Authority concerned invoking the provisions under Section 110 Cr.P.C. issued a notice of forfeiture of Bond executed by the petitioner for a period of six months. On 1.12.2015, the petitioner was remanded to judicial custody. Heard and perused the material available on record. From the material on record, it is apparent that the petitioner was remanded to judicial custody in pursuance of the order passed under the provisions of Section 110 Cr.P.C. Therefore, this Court is of the view that the present petition is not maintainable. However, the petitioner is at liberty to approach the appropriate forum under the appropriate provisions of law.
