THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA Writ Petition No.35416 of 2016 ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) Sri K.Durga Prasad, learned counsel for the petitioner, seeks permission to withdraw the writ petition with liberty to prefer an appeal. While Sri J.Anil Kumar, learned Special Standing Counsel for Commercial Taxes, would submit that the time specified for preferring an appeal has already expired, this is a matter which the Appellate Authority shall examine in deciding whether or not to entertain the appeal.

The Writ Petition is dismissed as withdrawn. This order shall not preclude the petitioner from availing the remedy of an appeal if it is within the time specified in Section 31 of the A.P. Value Added Tax Act, 2005. Miscellaneous petitions pending, if any, shall also stand dismissed.
