THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43755 of 2016 ORDER:

The present writ petition is filed by the petitioners under Article 226 of the Constitution of India, seeking to declare the action of the 4th respondent in not initiating investigation in Crime No.92 of 2015, though it was registered on 02.07.2015, as illegal and arbitrary and consequently, direct the respondents 3 and 4 to initiate investigation in Crime No.92 of 2015.

Heard and perused the material available on record. The grievance of the petitioners is that on the basis of their complaint, FIR No.92 of 2015 was registered against the respondents 5 to 10 on the file of Kodumur Police Station, Kurnool District, on 02.07.2015, for the offence under Section 420 IPC, and even after lapse of nearly one and half years, the respondents 3 and 4 did not choose to conduct investigation.

Considering the facts and circumstances of the case and the grievance of the petitioners, without expressing any opinion on merits, the respondents 3 and 4 are directed to conduct investigation in the above crime, complete the same and file a final report, as expeditiously as possible.

With the above directions, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
