Srikesh Kanukunta, v. The State Of Telangana Rep. By Its Principal Secretary
HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17807 OF 2017 ORDER:
1.
This writ petition is filed by the petitioner seeking to direct the 2nd respondent to take action against the 3rd respondent for making illegal and unauthorized constructions.
2.
Heard and perused the material available on record. 3.
The main grievance of the petitioner is that on the western side of his house, the 3rd respondent started making constructions without obtaining permission from the 2nd respondent and without following the zonal regulations and without leaving the setbacks as required HMC Act and he made representations before the 2nd respondent on 22.5.2017 and 27.5.2017. But the 2nd respondent has not taken any action so far. The 3rd respondent is proceeding with the constructions illegally. 4.
Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order:
"If there was any complaint or representation made by the petitioner, the official respondents are directed to take appropriate action in accordance with law against the unauthorized constructions or deviations alleged to have been made by the 3rd respondent."
5.
With the above direction, the Writ Petition is disposed of. No costs. Consequently, Miscellaneous petitions pending, if any, shall stand closed. _________________ JUSTICE RAJA ELANGO Dated: 6th June, 2017 Nn.
