THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40801 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking a writ of mandamus declaring the action of the respondents in not considering the proposal of the petitioner dated 31.10.2016 for including the petitioner-college for renewal of the academic year 20162017 in Indian Nursing Council List as well as not including the petitioner college name in web-counselling which is scheduled to be held on 24.11.2016 and 25.11.2016 in 2nd respondent office for the academic year 2016-2017 (B.Sc. Nursing) as illegal and arbitrary. The petitioner-college applied for renewal of the permission for the academic year 2016-2017 along with relevant documents. It is alleged that even though the said representation was received by the respondents on 31.10.2016, till date no orders have been passed.

Admittedly, the first counselling was already completed on 24.11.2016 and 25.11.2016 and the second counselling is likely to be conducted in the second week of December, 2016. Hence, the petitioner approached this Court with a prayer to direct the respondents to dispose of the representation of the petitioner dated 31.10.2016. But, the learned Assistant Solicitor General representing the 1st respondent seeks time to get instructions.

Taking into consideration the fact that the second counselling will start in the second week of December, 2016, without going into merits of the case, the 1st respondent is directed to dispose of the representation of the petitioner dated 31.10.2016 on or before the date fixed for second counselling. If no such action is taken by the 1st respondent within the

stipulated time, the petitioner is hereby permitted to continue the course for the academic year 2016-2017 and the 2nd respondent is also directed to allot the students to the petitioner-college. With the above direction, the writ petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J 30.11.2016.
