HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.690 of 2017 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking to quash the proceedings against them in C.C.No.342 of 2016 on the file of the I-Additional Judicial First Class Magistrate, Godavarikhani.

Heard and perused the material available on record. The petitioners are alleged to have committed the offences punishable under Sections 498-A IPC and 3 & 4 of the Dowry Prohibition Act. Considering the circumstances of the case, this Court is not inclined to interfere with the proceedings in the above C.C. At this stage, learned counsel for the petitioners submitted that the petitioners 2 and 3 are old aged persons, and hence their presence may be dispensed with before the trial Court.

In view of the submission of the learned counsel for the petitioners, the presence of the petitioners 2 and 3 only is dispensed with before the trial Court is dispensed with except on the dates when their appearance is specifically required by the trial Court. Accordingly, the Writ Petition is dismissed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
