THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE G. SHYAM PRASAD C.M.A.No. 981 of 2013 JUDGMENT: (Per VRS,J) This appeal by the husband is against the dismissal of his petition for divorce by the trial Court.

During the pendency of the appeal, the parties have entered into a Memorandum of Compromise, dated 23.05.2016. As per the terms of the Memorandum of Compromise, the husband agreed to pay Rs.3,00,000/- in full and final settlement of all claims, past, present and future. Accordingly, a sum of Rs.1,00,000/- was already paid on 29.03.2016.

Both parties are present in Court. Today, two demand drafts bearing Nos.446649 and 446660, dated 08.12.2016 and 09.12.2016, respectively, drawn on State Bank of Hyderabad, in favour of the wife, each for a sum of Rs.1,00,000/-, are handed over in Court to the wife. Admittedly, the articles presented at the time of marriage have been returned to the wife. There is also a criminal revision case pending on the file of this Court arising out of an order for

VRSJ & GSPJ CMA No.981 of 2013 maintenance. The learned counsel for the wife states that the compromise will be recorded even therein and the matter closed. 4.

In view of the above, the appeal is disposed of, in terms of the Memorandum of Compromise, dated 23.05.2016, to the following effect:

1) The marriage between the petitioner and the respondent solemnized on 30.04.2008 shall stand dissolved by a decree of divorce, by mutual consent, without reference to the allegations on both sides.

2) The husband has paid a sum of Rs.3,00,000/- (Rupees Three lakhs only) to the wife towards full and final settlement.

3) The articles given at the time of marriage have been returned to the wife.

4) There will be no further or other claims between the parties as against one and another.
