HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.42576 OF 2016 ORDER:

The present writ petition is filed by the petitioner seeking to direct the respondents not to interfere with the possession of the petitioner over the land of an extent of Ac.8.73 cents in Sy.No.59 of Tumpally village, Asifabad Mandal, Asifabad District, pending disposal of the revision before the 2nd respondent.

Heard and perused the material available on record. The case of the petitioner is that he purchased the above said land from the 6th respondent through an unregistered agreement of sale in the year 1967 and subsequently, a registered sale deed, dated 12.08.1975, was executed by the 6th respondent duly acknowledging the agreement of sale, and in the pahanies of the village, the name of the petitioner was also shown in the possession column. While so, the 4th respondent passed an ejectment order on 12.02.1996 against the petitioner, since the transaction took place between the petitioner and the 6th respondent is in contravention of the provisions of APSALTRA 1970, and against the said order, the petitioner filed an appeal before the 3rd respondent. The 3rd respondent dismissed the appeal vide order, dated 23.04.2005, by confirming the order passed by the 2nd respondent. Thereafter, the petitioner filed a revision petition before the 2nd respondent against the order of dismissal by the 3rd respondent along with a stay application, on 19.10.2016.

The main grievance of the petitioner is that though he filed the revision petition on 18.10.2016, till today, no orders are passed by the

2nd respondent on the said revision or the on stay application, and the respondents are taking steps to evict him from the subject property. Considering the grievance of the petitioner, without expressing any opinion on the merits of the case, this Court is inclined to pass the following order:

The 2nd respondent is directed to consider the revision petition, dated 18.10.2016, filed by the petitioner, as expeditiously as possible, more preferably, within a period of two (2) months from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
