Learned counsel for the petitioner prays for withdrawal of the writ petition and submits that observations may be made that the enquiry that was initiated against respondent No.6 may be continued.

Writ petition is disposed of as withdrawn. We are not issuing a direction as prayed for. However, we observe that if any enquiry is either initiated or contemplated against respondent No.6, it is open to the concerned authority to either prosecute the enquiry or initiate proceedings against respondent No.6, if they so desire. While passing this order, we shall not be understood to have issued any direction as such to the concerned authority against respondent No.6. It is made clear that we have not examined allegations against respondent No.6 and if any enquiry is either initiated or prosecuted on the basis of initiation of enquiry earlier, the same shall be considered strictly on merits in accordance with law.
