THE HON'BLE SRI JUSTI CE SURESH KUMAR KAI T CRL.P.NOS.3 3 3 4 AND 1 1 0 4 2 OF 2 0 1 3 COMMON ORDER The 2nd respondent in both the petitions is the de facto complainant. She lodged complaint in FIR.No.1419/ 2009 on the file of Police Station, Kukatpaly against the accused 1 to 7 for the offences punishable under Sections 420, 406, 493, 494, 498(A), 506, 120-B read with 34 IPC and Sections 3 and 4 of Dowry Prohibition Act. After filing of the charge sheet, the case is numbered as C.C.No.1760/ 2010 on the file of IX Metropolitan Magistrate at Cyberabad, Kukatpally. For quashing the proceedings in C.C.No.1760/ 2010, the accused Nos.2 to 7 filed petition before this court under Section 482 of Cr.P.C. in Crl.P.No.3334 of 2013 and the accused No.1 filed Crl.P.No.11042 of 2012. Hence, both the petitions are being disposed of by this common order.

Heard the learned counsel for the petitioners/ accused 1 to 7 in both the petitions, learned counsel for the 2nd respondent - de facto complainant and the learned Additional Public Prosecutor for the 1st respondent - State.

The learned counsel appearing on behalf of the petitioners submit that the petitioners/ accused 1 to 7 and the 2nd respondent - de facto complainant have settled all disputes amicably and to that effect entered into a memorandum of understanding dated 9.9.2016 and, therefore, sought to quash the proceedings.

The de facto complainant is personally present in court with her counsel. For her identity, she produced her Adhar Card issued by the Government of India bearing No.364960333455. The same is perused and returned.

She states that the matter has been compromised. She does not want to pursue further against the petitioners and that if the quash petitions are allowed, she has no objection.

Keeping in view the settlement arrived at between the parties, Crl.P.No.18756/ 2016 in Crl.P.No.3334/ 2013 and Crl.P.M.P.No.18765/ 2016 in Crl.P.No.11042/ 2013 filed for compounding the offences, are allowed and consequently the proceedings in C.C.No.1760/ 2010 on the file of IX Metropolitan Magistrate at Cyberabad, Kukatpally against the petitioners/ A-1 to A-7 are hereby quashed.

The criminal petitions are accordingly allowed in terms of the compromise.
