HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.12923 OF 2017 ORDER:
The case of the petitioner is that he is the absolute owner and possessor of the agricultural land to an extent of Ac.4.94 cents in Survey No.123, situated at Ganapavaram Village, Nadendla Mandal, Guntur District. As the boundaries of the said land are not clear, the petitioner submitted application dated 27.11.2015 seeking survey of the subject land and to fix boundaries by paying the requisite fee. In pursuance of the said application the Mandal Surveyor conducted survey on 19.12.2015 by fixing the boundaries to the subject land and submitted survey report to the 3rd respondent in the month of August, 2016. But, inspite of repeated requests for release of the survey report and plan, the 3rd respondent did not respond so far. Aggrieved by the inaction of the 3rd respondent in releasing the survey report and plan, present writ petition is filed.
Learned Assistant Government Pleader for Revenue submits that the petitioner has to make necessary application to the 3rd respondent.
Learned counsel for the petitioner submits that the petitioner will make necessary application to the 3rd respondent. In view of the above, it is open for the petitioner to make necessary application for issuance of survey report and plan
said to have been conducted on 19.12.2015, to the 3rd respondent and on such application being filed by the petitioner, the 3rd respondent is directed to consider the said application and pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order. With the above direction, the writ petition is disposed of. No order as to costs.
