Petitioner alleges that the neighbouring property owner who is arrayed as 5th respondent in this writ petition, dug a bore well without obtaining permission and the said bore well is in clear violation of the mandate of the A.P.Water, Land and Trees Act, 2002. Alleging inaction on the complaint filed by the petitioner, this writ petition is filed.

Learned counsel representing the 5th respondent submits that challenging the show cause notice issued to the 5th respondent, she filed W.P.No.25609 of 2017. By order dated 02.08.2017, the said writ petition was dismissed granting liberty to the petitioner to raise all objections as available in law. He further submits that in pursuant thereon, the objections were filed. 4.

Since the 5th respondent claims that objections are already filed, both counsel agree for disposal of the writ petition with a direction to the Tahsildar-cum-Mandal Level Authority, Bukkarayasamudram Mandal, Anantapur District (4th respondent), to finalize the issue on the complaint filed by the petitioner. 5.

Having regard to the said submissions, the writ petition is disposed of directing the 4th respondent to consider the rival claims and pass appropriate orders, as warranted by law, by assigning due reasons in support of his decision, as expeditiously as

- 3 - possible, preferably within a period of four (4) weeks from the date of receipt of copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
