3 The Revenue Divisional Officer, Nampally, Hyderabad. 4 The Tahsildar, Saidabad Mandal, Hyderabad District. .....Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the Affidavit filed here in the High Court may be pleased to issue any writ, order or direction more particularly one in the nature of 'Mandamus' declaring the action of the 4th respondent and his/her subordinates in seeking to dispossess the petitioner from his Plot No.7 in Sy.Nos.33 of 36 of Saidabad, Hyderabad to an extent of 267 sq.yards as illegal, improper and contrary to the principles of natural justice and against the procedure laid down under the Land Encroachment Act, and consequently, direct the 4th respondent or his subordinates not to interfere with the peaceful possession and enjoyment of petitioner in respect of Plot No.7 in Sy.Nos.33 to 36 of Saidabad, Hyderabad to an extent of 267 sq.yards;

The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of SRI D.RAMAKRISHNA Advocate for the Petitioner, and of learned Government Pleader for Revenue (T.G.) for Respondent Nos. 1 to 4 and the Court made the following:

The instructions of the learned Govt. Pleader however, state that the land in question is surplus land notified under Urban Land (Ceiling & Regulation) Act, 1976 and the Govt. had taken possession under a panchanama, dt.20.02.2008 and the said land is now proposed for construction of Vegetable Market by GHMC. Hence, pending further orders, any action taken by the respondents with regard to the plot of the petitioner in question, shall be subject to further orders in this writ petition.
