THE HON'BLE SRI JUSTICE M.GANGA RAO WRIT PETITION No.18922 OF 2007 ORDER :

This writ petition is filed seeking a Writ of Mandamus to declare the impugned Notification No. R.C.G.2 2854/07, dated 13.6.2007 issued by the respondent No.2-District Collector, Krishna District published in Eenadu on 14.06.2007 seeking to acquire the lands of the petitioners in Survey Nos.206/1A and 206/1B1 of Jakkampudi village, Vijayawada Rural, Krishna district as illegal, arbitrary and violative of Articles 14 and 300-A of the Constitution of India.

Questioning the very same Notification, dated 13.06.2007 issued by the District Collector, Krishna District, a batch of cases in W.P.No.4360 of 2007 and Batch were filed and this Court allowed the same by order dated 04.06.2010, relying on the Judgment in Gajjella Narsimha Reddy v. Collector, Ranga Reddy District1 holding that "the purpose for which the land was proposed to be acquired is vague, struck down the notification". It is fairly conceded by the learned Assistant Government Pleader for Land Acquisition (A.P.) that following the order dated 4.6.2010 in W.P. No.4360 of 2007 and Batch, this Court by common order dated 25.07.2017 allowed W.P. No.10656 of 2007 1 2008(5)ALD 302

and Batch by quashing the impugned notifications therein, dated 05.05.2007 and 13.6.2007.

The present writ petition is also pertaining to the same batch of cases and is filed challenging the very same notification dated 13.6.2007.

Hence, this writ petition is also allowed in terms of the orders of this Court passed in W.P.No.4360 of 2007 and Batch, dated 04.06.2010 and the impugned notification dated 13.6.2007 is quashed.

Miscellaneous petitions pending, if any, in the writ petition shall stand closed. No order as to costs.
