This revision is filed aggrieved by order dated 06-082019 passed in I.A.No.96 of 2019 in O.S.No.1559 of 2014, wherein and whereby the application filed by the respondents under Section 45 of Indian Evidence Act was allowed for sending the document of sale deed vide Doct.No.13738/1994 and another sale deed vide Doct.No.13674/1994 to the handwriting expert for comparing the signature of late Sri Balbeer Singh, who is the husband of respondent No.1 and father of respondents 2 to 4, in the above sale deeds and signatures containing in the Government document i.e. in the acknowledgments of Income Tax Department (I.T.returns). Heard learned counsel for the petitioners, who, submits that the respondents are seeking for comparison of signatures of the documents pertaining to the year 1994, as such there is likelihood of change in the signature of Balbeer Singh from time to time. He also submits that as the respondent No.3/plaintiff alleged that his father operated locker No.A1250 in Central Bank of India, Musheerabad, the signatures obtained by said bank can be obtained for comparison.
Heard respondent-No.3, who is appearing as party-inperson, submits that he has no objection for comparison of the signatures of his father in the documents pertaining to Locker No.A1250 in the Central Bank of India, Musheerabad. In view of the same, the revision is disposed of modifying the order of trial Court as under:
The trial Court shall take steps for collecting documents containing the signatures of father of respondent No.3 in respect of documents pertaining to locker No.A1250 of Central Bank of India, Musheerabad and send them to the handwriting expert for comparison and opinion. As a sequel, miscellaneous applications pending, if any, shall stand closed.
