THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.30963 OF 2016 ORDER:

This writ petition is filed seeking to issue a writ of mandamus to declare inaction of respondent Nos.2 and 3 in providing alternate business sites to the petitioners for carrying out their petty businesses, having dispossessed in the process of road widening undertaken by the 3rd respondent, as illegal and arbitrary, and consequently, sought a direction to the respondents to forthwith provide alternate business sites within the Municipal limits for relocating the petitioners businesses. Heard and perused the material available on record. When the matter is taken up for hearing learned Standing Counsel for the 3rd repondent submitted that the respondents are considering the request of the petitioners for allotment of alternate premises and since the premises i.e.

R&B Road Dharabji to Kubeer Road is under the control of R & B Department, they approached the R & B officials, who also consented for handing over the said premises to the 3rd respondent and after handing over the said premises by the R & B department, 3rd respondent will allot the same to the petitioners within a period of eight weeks.

Recording the said submission of the learned Standing Counsel and in terms thereof, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, pending if any, shall stand closed. ______________ RAJA ELANGO, J June 19, 2017 KTL
