This Criminal Petition is filed under Section 482 of Cr.P.C. for quashing the proceedings in D.V.C.No.28 of 2012 on the file of the Judicial First Class Magistrate, Kodad, Nalgonda District. 2.

Heard both sides and perused the record.

In view of the decision rendered by this Court in Gaddameedi Nagamani Vs. State of Telangana & Others1, the order of taking cognizance by the Magistrate under the provisions of the Domestic Violence Act, 2005 (for short 'the Act'), is an appealable order Section 29 of the Act. Therefore, the parties are directed to workout their remedies under the Act in accordance with law.

The Registry is directed to return the certified copy of the petition in D.V.C.No.28 of 2013 on the file of the Judicial First Class Magistrate, Kodad.

Subject to above observation, this Criminal Petition is dismissed. Miscellaneous petitions, if any pending in this Criminal Petition, shall also stand dismissed.
