O R D E R :

This writ petition is filed by the petitioner seeking mandamus to declare the inaction of respondent No.1 in not taking action against respondent Nos. 2 and 3 on the representation of the petitioner dated 11/7/2016 as arbitrary, unfair, unreasonable, discriminatory and unconstitutional being violative of Articles 14 and 21 of the Constitution of India and consequently to direct the respondent No.1 to take action for demolition of the said building bearing building at H.No. 2-13-21, Jubliee House, Main Road, Karkhana, Secunderabad, according to the provisions of Section 248 and 249 of the Cantonments Act, 2006 and to pass such other suitable orders as this Court may deems fit and proper in the circumstances of the case.

2. Counsel appearing on behalf of the petitioners submits that for the aforesaid relief, the petitioner filed a representation dated

11/7/2016 to the first respondent, however, till date neo decision has ever been communicated to the petitioners.

3. Notice issued. Sri K.R. Koteshwar Rao, learned standing counsel takes notice on behalf of respondent No.1 and has assured to this Court that the representation dated 11/7/2016 filed by the petitioner will be decided within the time stipulated by this Court.

4. keeping in view, the averments made in the affidavit filed in support of the petition and submission of the counsel for the petitioner, I hereby direct the respondent No.1 to consider and dispose of the representation mentioned above filed by the petitioners and pass appropriate orders on merits and in accordance with law, within four weeks from the date of receipt of a copy of this order. I further make it clear that the orders passed on the representation dated 11/7/2016 shall be communicated to the petitioners in writing within one week thereafter.

5. In view of the above direction, the writ petition is disposed of at the stage of admission. No costs.

6. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
