THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7053 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A5 seeking bail in the event of his arrest in connection with Crime No.600 of 2023 on the file of the Station House Officer, Saroornagar Police Station, Ranga Reddy District, registered for the offences punishable under Sections 498-A and 306 read with 34 of Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The case of the prosecution is that the deceased committed suicide as she was unable to bear the harassment of her husband, who was torturing her physically and mentally. A suicide note was written by the deceased that her husband, mother-in-law and sister-in-law were responsible for her suicide. In the suicide note, it was further alleged that the petitioner, who was working in the office of the Director of Public Health & Family Welfare, Koti, Hyderabad, was responsible for the deceased not getting promotion by misguiding the D.E and there are no other allegations. Petitioner, who was the public servant, can be granted

anticipatory bail since no allegations are made in the suicide note which amounts to abetment.

In the said circumstances, the petitioner/A5 shall be enlarged on bail in the event of his arrest, subject to the following conditions:

1) The petitioner/A5 is directed to surrender before the Station House Officer, Saroornagar Police Station, Rangareddy District on 10.08.2023. On such surrender, the said Station House Officer shall release the petitioner/A5 on bail on his executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/A5 shall appear before the concerned Station House Officer as and when required, for the purpose of investigation.

3) The petitioner/A5 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
