J. Rama Devi v. S. Ravindram
THE HON'BLE DR. JUSTICE SHAMEEM AKTHER MACMA No.246 of 2006
JUDGMENT
Though the matter underwent several adjournments under the caption 'For Dismissal' none appears for appellant/claim petitioner. On 27.01.2017, when the matter came up for hearing, none appears for appellant and heard the arguments of learned counsel for respondents 2 and 3 and adjourned the matter to today under the caption 'For orders'. Even today also, there is no representation on behalf of appellant. Therefore, it seems that the appellant has no interest in prosecuting the matter.
2.
While going into the merits of the matter, as seen from the order impugned, the Tribunal, after considering the evidence of P.Ws.1 to 3 and R.W.1 coupled with Exs.A1 to A15 and also Exs.B1 to B4, has determined the compensation of Rs.78,713/- as against the claim of Rs.4,53,040/- for the injuries sustained by appellant/ petitioner, in a motor vehicle accident occurred on 25.05.2002, due to rash and negligent driving of driver of Tipper bearing No. TN-49C4666 at Okkur Village, Sivaganga District, Tamilnadu. The Tribunal has analyzed the entire evidence on record and awarded just and reasonable compensation under all the heads and there is no need to interfere with the order under appeal by this Court. 3.
In view of the above, the appeal is dismissed. No order as to costs. Miscellaneous applications, if any, pending in this appeal shall stand dismissed.
