THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO CRP.No.1898 of 2016 ORDER :

This Revision is filed challenging the order dt.22.03.2016 in O.S.No.151 of 1996 passed by the Senior Civil Judge, Mahabubabad to the extent that the Court directed that Travelling Allowance and Dearness Allowance expenses of counsel for respondents should be paid by petitioner for cross-examination of an expert witness at Delhi.

Although the counsel for petitioner contended that petitioner cannot be made liable to pay Travelling Allowance and Dearness Allowance of the counsel for respondents, it is not in dispute that on two earlier occasions the expert witness DW.2, who is an expert in hand-writing and resident of Delhi, was examined in part by petitioner and his cross-examination remained incomplete on his last visit on 28.11.2014, and the witness himself requested that cross-examination be continued in Delhi.

In this view of the matter, I am not inclined to interfere with the impugned order since I do not find any error of jurisdiction in the said order. Accordingly, the Civil Revision Petition is dismissed. No order as to costs.

However, it is made clear that any expenditure incurred in this regard will abide by the result in the suit. 5.
