THE HONOURABLE SRI JUSTICE RAJA ELANGO TRANSFER CRIMINAL PETITION No.83 OF 2016 ORDER:

This Transfer Criminal Petition is filed under Section 407 of Code of Criminal Procedure (Cr.P.C.) to transfer C.C.No.1461 of 2015 on the file of the IV Additional Chief Metropolitan Magistrate, Vijayawada City to the Court of the II Additional Judicial Magistrate of First Class, Ongole.

Heard and perused the material available on record. Learned counsel for the petitioner/complainant submits that the petitioner is residing at Ongole and it is practically impossible for the petitioner to attend adjournments in the said case at Vijayawada and that there is a life threat to the petitioner in the hands of the second respondent and as such, prays this Court to transfer the above C.C., to Ongole from Vijayawada.

Considering the facts and circumstances of the case, the presence of the petitioner herein before the trial Court is dispensed with except on the date of examination of the petitioner. The petitioner is directed to be represented by her counsel before the Court below on all hearing dates.

The Transfer Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
