THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7048 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioners/A1 to A3 in the event of their arrest in Crime No.123 of 2023 on the file of Station House Officer, Khammam I Town Police Station, Khammam District registered for the offence punishable under Section 306 r/w 34 of Indian Penal Code.

Heard learned counsel for petitioners and learned Assistant Public Prosecutor for respondent-State. Perused the record. 3.

The allegation against the petitioners is that the first petitioner, who was the friend of the deceased obtained an amount of Rs.14,80,000/- as loan repayable in installments. When the deceased asked to return to the said amount, the petitioners refused to return the same and threatened the deceased. He has written a suicide note stating that an amount of Rs.14,80,000/- was not returned by the first petitioner and when asked the petitioner Nos.2 and 3 also along with others threatened him.

Keeping in view that the suicide was committed on account of not returning the money which was earlier given as loan, the petitioners/A1 to A3 can be granted relief of anticipatory bail. 5.

Accordingly, the Criminal Petition is allowed and the petitioners/A1 to A3 shall be enlarged on bail in the event of their arrest subject to the following conditions:

i) The petitioners/A1 to A3 are directed to surrender before the Station House Officer, Khammam I Town Police Station, Khammam on 10.08.2023, and on such surrender, they shall be enlarged on bail on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties to the like sum each, to its satisfaction.

ii) The petitioners/A1 to A3 shall appear before the concerned Station House Officer on every Monday between 10.00 AM and 01.00 PM for a period of two (02) months, for the purpose of investigation.

iii) The petitioners/A1 to A3 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and shall co-operate with the investigating Officer in investigating the case.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
