HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.7212 of 2008 ORDER:
The petitioner complains against inaction of 2nd respondent in considering and disposing of representation dated 29.01.2008 as illegal, arbitrary and unconstitutional.
The writ petition was filed on 30.03.2008. The learned counsel appearing for the parties are unable to place before the Court the present state of affairs vis-à-vis the representation or the alleged unauthorized construction by respondents 3 and 4.
Having regard to the above circumstances, this Court is not considering the writ prayer.
Writ petition is dismissed. However, if the cause of action in any form against respondents 3 and 4 still subsists, it is open to the petitioners to workout their remedies in accordance with law. Pending miscellaneous petitions, if any, shall stand closed. No costs.
