HONOURABLE SRI J USTICE SURESH K UMAR K AIT CRIMINAL PETITION No. 14952 of 2016 ORDER:
Vide present Criminal Petition, the petitioner seeks anticipatory bail in the event of his arrest in connection with Crime No. 3 of 2016 on the file of Station House Officer, Police Station, Donkarai, East Godavari District, registered for the offences punishable under Section 8(c) read with Section 20(b)(ii)(c) of the NDPS Act.
Learned Additional Public Prosecutor appearing on behalf of the respondent/State has informed this Court that the petitioner earlier moved two anticipatory bail applications and the same were dismissed by this Court. The same is evident from the last order dated 22.08.2016 passed in Criminal Petition No. 12145 of 2016. Learned Additional Public Prosecutor further submits that the petitioner nowhere in the present petition has disclosed the fact that earlier he moved two bail applications and the same were dismissed by this Court.
The present Criminal petition is concealment of aforesaid facts and therefore the same cannot be accepted and entertained by this Court.
Accordingly the present Criminal Petition is dismissed with costs of Rs.25,000/-. The costs shall be paid in favour of the District Bar Association, East Godavari District within one week from today. If the petitioner fail to deposit the said amount as
directed above, the Registrar General shall recover the said amount from him under the Revenue Recovery Act.
