ORDER

This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused seeking to enlarge him on bail in connection with Crime No.246 of 2026 of Jubilee Hills Police Station. The offences alleged against the petitioner are punishable under Sections 69, 74 and 79 of BNS Act.

The case of the prosecution is that the de facto complainant lodged a report before police on 16.04.2026 stating that she had been acquainted with the petitioner since the year 2021. Later the petitioner herein proposed

her and she also accepted the same. Thereafter, under the pretext of false promise of marriage, the petitioner indulged in physical relationship with the de facto complainant and he also took amount from the victim several times and when she demanded for repayment of amount, petitioner herein refused to marry her and physically assaulted her. Basing on the said report, police registered a case against the petitioner for the offences under Sections 74 and 79 of BNS and after recording the statement of victim they altered the same and invoked Section 69 of BNS. 3.

Heard Sri C.Vijaya Sekhar Reddy, learned counsel for the petitioner/Accused, Sri Y.Charan Baba, learned counsel for de facto complainant and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for the respondent-State.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and he is innocent of the offences alleged against him. He contends that to attract offence under Section 69 of BNS, it must be shown that promise of marriage was false from the very inception. However, in the present case, the relationship between the petitioner and de facto

complainant was consensual in nature. The petitioner is in jail since 02.05.2026. He further submits that entire investigation is completed. Therefore, prays this Court to grant regular bail to the petitioner.

On the other hand, learned counsel for the de facto complainant submits that investigation is not yet completed and under the guise of marriage, the petitioner deceived the victim and sexually exploited her and there are several documents with the victim to prove the same and requested this Court to dismiss the petition. 6.

Learned Additional Public Prosecutor opposed the same on the ground that the investigation is not yet completed and the offences are heinous in nature and requested this Court to dismiss the petition. 7.

Considering the submissions made by learned counsel for the petitioner, learned counsel for de facto complainant and learned Additional Public Prosecutor, it is evident that the petitioner is in jail since 02.05.2026 and record shows that the petitioner and de facto complainant were in relationship from 2021, which appears to be consensual in nature. In the said circumstances, this

Court deems it fit to grant bail to the petitioner/Accused subject to the following conditions:

(i) The petitioner-accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the XVII Additional Chief Judicial Magistrate, Hyderabad.

(ii) On such release, the petitioner-accused shall appear before the concerned S.H.O. between 09:00 a.m., and 5:00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) The petitioner-accused shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS). 8.

Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
