THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE T.AMARNATH GOUD WRI T PETI TI ON NO.17159 of 2018 ORDER: (per SK,J) The grievance of the petitioner in this case is with regard to the action of the Canara Bank in conducting an e-auction sale in respect of a property situated in Narsampet Village and Mandal, Warangal District, without disclosing that the conformation of the sale in respect thereof was stayed by the jurisdictional Debts Recovery Tribunal. A consequential direction is sought by him to direct the bank to refund the amount deposited by him pursuant to the sale that took place on 07.04.2018 in respect of the said property wherein he was declared the highest bidder. Sri Dishit Battacharjee, learned counsel for Canara Bank, would inform this Court that the bank has now decided to nullify the sale held on 07.04.2018 and is wiling to return the amount deposited by the petitioner. The said statement is taken on record.
In the light of the decision of the bank as recorded, the grievance of the petitioner stands settled.
The writ petition is accordingly disposed of directing the Canara Bank to expeditiously refund the amount deposited by the petitioner.
