HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.10711 of 2013 ORDER:

Petitioners have filed this Writ Petition assailing the order in proceedings No. J/5623/2008 dated 21.3.2011 of the first respondent granting occupancy right certificate in favour of respondents 4 to 11 in respect of land of extent of Ac. 1.16 gts in S.No. 568 and Ac. 13.12 gts in S.No. 569 of Nallavelli Village, Yacharam Mandal, Ranga Reddy District.

The ground on which the writ petition has been filed is that no notice has been given to the petitioners though they are in possession of the said land.

According to petitioners, they are shown by revenue records to be in possession prior to 1.11.1973 as well as after 1.11.1973 (though their names are not reflected in the pahani for the year 1973-74). 4.

This Court while admitting the Writ Petition directed that the respondents 4 to 11 shall not alienate the property until further orders in WPMP No. 13271 & 13272 of 2013.

WVMP No. 4268 of 2015 is filed to vacate the said order.

Counsel for the respondents 4 to 11 stated that petitioners had filed objections before the first respondent and that those objections were also taken into account by the first respondent while passing the impugned order. It is also pointed out that the petitioners had preferred an appeal F1/4258/2011 under Section 24 of the A.P. (Telangana Area) Abolition of Inams Act, 1955 before the Joint Collector of Ranga Reddy District against the impugned order and that the said appeal is still pending before the said authority.

In this view of the matter, this Writ Petition is disposed of directing the second respondent to instruct the Joint Collector, Ranga Reddy District, to dispose of the appeal F1/4258/2011, pending on his file, within two months from the date of receipt of a copy of this order. WVMP No. 4268 of 2015 is allowed to the above extent. No costs. 8.

As a sequel there to, miscellaneous applications, pending if any, shall stand closed.
