THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.7508 of 2016 ORDER:
The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in Cr.No.115 of 2016 of Jammikunta Police Station, Karimnagar District, registered for the offences punishable under section 420 IPC.
Heard the learned counsel appearing for the petitioner/accused and the learned Additional Public Prosecutor, representing the State. It is alleged in the complaint that the petitioner/accused has collected Rs.16 lakhs from the de facto complainant stating that he would provide Attender and Clerk jobs in Shatavahana College, Karimnagar to the de facto complainant and others but he neither provided the employment nor returned the amount received. There are specific allegations made against the petitioner/accused, which, prima facie, reveal the commission of offence, as alleged. This is a matter which requires investigation by the police, and there are no valid grounds to quash the First Information Report.
In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the Criminal Petition is disposed of, directing the investigating agency to proceed with the investigation, however, without arresting the petitioner in the above crime, till the investigation is completed and the charge sheet is filed. Pending miscellaneous applications, if any, shall stand closed in consequence.
