Heard the learned counsel for the petitioner as well as the learned Standing Counsel appearing for the respondents. The prayer sought in the Writ Petition is as under: " .....to issue a writ, order or direction more in the nature of Mandamus declaring the action of the respondent without following due process of law state away locked the petitioners Flat bearing No. 401/D on fourth floor bearing M.C.H.No.7-1-215/B/G/401/D in the building known as "TIRUMALA TOWERS" M.C.H.No.7-1-215/B/G in plot No.A in the survey No.76 situate at Bahloolkhanguda, Hyderabad, A.P. as illegal, arbitrary, unjust and opposed to all principles of natural justice, equity and fair play and contrary." During the course of hearing, learned counsel for the petitioner seeks permission of this Court to withdraw the Writ Petition with a liberty to move an appropriate application against the proceedings passed under Section 14 of the SARFAESI Act. Acceding to the said request, Writ Petition is dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
