THE HON'BLE SRI JUSTI CE ABHI NAND KUMAR SHAVI LI WRI T PETI TI ON NO.26533 OF 2000 ORDER:

It is reported by Sri A.K.Jaya Prakash Rao, learned counsel for the petitioner that the petitioner in this case has expired almost ten years back and in spite of his best efforts, he could not trace out the legal representatives of the deceased petitioner.

This is a case where the employer had filed this writ petition challenging the orders passed by the Industrial Tribunal-cum-Labour Court, Warangal in MP.No.56 of 1997 dated 8.12.2000. The Hon'ble Industrial Tribunal-cum-Labour Court allowed the said MP filed by a workman i.e., the 2nd respondent and directed the petitioner herein to pay an amount of Rs.1,01,875.18 ps towards the differential wages and ex-gratia for the period from May, 1986 to March, 1997. Questioning the said orders passed in MP.No.56 of 1997, the present Writ Petition was filed and the petitioner had obtained blanket stay orders from this Hon'ble Court vide orders dated 29.12.2000.

Now after 17 long years from the date of filing of this Writ Petition, it is reported that the petitioner died ten years back and no effort is made to bring the legal representatives on record. 4.

The issue in the present writ petition pertains to payment of minimum wages to a driver, which was denied by the petitioner herein. 5.

I have considered the submissions made by both the parties and after perusing the record, I am not inclined to interfere with the orders passed by the Industrial Tribunal-cum-Labour Court. 6.

Accordingly, the writ petition is dismissed. However, the 2nd respondent is at liberty to pursue his remedies to recover the amounts as

quantified in MP.56 of 1997 dated 8.12.2000 from the properties of the deceased petitioner, if so advised.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
