HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.C.M.P.No.129 of 2016 ORDER:
This petition is filed to withdraw F.C.O.P.No.814 of 2015 from the file of Family Court, Ranga Reddy District at L.B. Nagar and transfer the same to Family Court, Vijayawada, Krishna District.
2. Wife filed this petition. According to her affidavit, her marriage with respondent was solemnized on 13.02.2013 at Annavaram, Sri Veera Venkata Satyanarayana Swamy Temple as per Hindu Religion and Caste custom. She stated that out of wedlock a male child was born on 02.01.2014. She stated that her husband and in-laws developed grudge against petitioner and her parents and started harassing her both physically and mentally and finally she was necked out from the matrimonial home in the month of April 2014. She stated that respondent filed FCOP No.814 of 2015 for restitution of conjugal rights before Family Court, Ranga Reddy and it is difficult for her to attend the Court at Ranga Reddy with a small child, as she has no relations in and around Ranga Reddy District.
She further stated that her father is aged about 59 years and working in Vijayawada in Central Government office and she had no brothers and there is none to accompany her from Vijayawada to Hyderabad for each and every adjournment. For these reasons, she prayed for transfer of O.P from Family Court, Ranga Reddy to Family Court, Vijayawada. 3.
Respondent did not file any counter disputing the affidavit averments of petitioner.
4. Heard both sides.
5. Advocate for petitioner reiterated the affidavit averments of petitioner and submitted that by taking the convenience of wife into consideration, O.P. may be transferred from Ranga Reddy to Vijayawada.
6. Advocate for respondent submitted that respondent is working as a teacher in a Private School at Hyderabad and it will be difficult for him to get leave for attending the Court at Vijayawada.
7. I have perused the material papers including affidavit of petitioner.
Considering the submissions of both sides and convenience of wife, F.C.O.P.No.814 of 2015 is withdrawn from the file of Family Court, Ranga Reddy District at L.B. Nagar and transferred to Family Court, Vijayawada, Krishna District for disposal in accordance with law. Family Court, Vijayawada shall dispense with the presence of husband i.e., respondent herein for each and every adjournment. However, respondent herein shall appear as and when his physical presence is felt necessary for any specific purpose.
8. Accordingly, this Transfer Civil Miscellaneous Petition is ordered. No costs.
Miscellaneous Petitions, pending in this petition, if any, shall stand closed.
