O R D E R

The respondent filed D.V.C.No.92 of 2013 on the file of II AJCJ - CUM - XIX Metropolitan Magistrate, Cyberabad, Kukatpally, at Miyapur against the petitioner and the same was allowed on 20.6.2016 and the petitioner herein was directed to pay an amount of Rs.5,000/- per month towards maintenance. As the petitioner has not paid the said amount, the respondent filed Crl.M.P.No.782/2016 in DVC.No.92 of 2013 and by docket order dated 1.6.2016, the trial court directed the petitioner herein to pay the arrears amount of Rs.40,000/- on or before 20.6.2016 . Challenging the same, the petitioner filed the present criminal petition. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the 1st respondent - State. Against the order dated 20.6.2016 in DVC. No.

92 of 2013, the petitioner has filed an appeal in DVC Appeal No.618/2015 on the file of II Additional District Judge, L.B. Nagar and the same is pending and no stay has been granted by the lower appellate court. If the petitioner is aggrieved by the impugned order, he is always at liberty to avail appropriate remedy available under law and I do not find any merit in the criminal petition and with this observation, the criminal petition is disposed of.
