THE HON'BLE SRI JUSTICE T. VINOD KUMAR Writ Petition No.19764 of 2019 ORDER:

The present writ petition is filed to declare the action of the respondents in interfering with the petitioners' peaceful possession and enjoyment of the agricultural land in Survey Nos.33, 35/aa and 36, total admeasuring Ac.5.09 guntas situated at Hasnabad Village, Kodangal Mandal, Vikarabad District, as being illegal and arbitrary.

Heard Sri B. Ramulu, learned counsel for the petitioners and the learned Government Pleader for Home appearing for the respondents.

Today when the matter is called for hearing, there is no representation on behalf of the petitioners. On the previous hearing also i.e., on 06.11.2019, there was no representation on their behalf.

While denying the averments made in the writ affidavit, the learned Assistant Government Pleader for Home, on the basis of written instructions dated 11.09.2019, a copy of which is placed on the record of this Court, submits that the respondent police authorities never interfered with the petitioners' peaceful possession and enjoyment of agricultural land at any point of time.

The learned Assistant Government Pleader further submits that as per the orders of the learned Junior Civil

Judge, Kodangal, police aid was provided to one Sri Chettukindi Shekharaiah on 25.07.2019 for ploughing his land and that the police authorities never interfered in the civil dispute.

The learned Assistant Government Pleader further submits that with regard to the subject land, the petitioners 1 to 3 and others are involved in two other cases i.e., i) Crime No.61 of 2016, wherein charge sheet was filed, vide C.C.No.545 of 2016 on the file of the Judicial Magistrate of First Class, Kodangal; and ii) another case being Petty Case No.37 of 2016 of Kodangal Police Station, which was registered on 16.05.2016.

Having regard to the said submissions made on behalf of the respondents, inasmuch it is stated in the written instructions that the respondent police authorities are never interfered with the peaceful possession and enjoyment of agricultural land of the petitioners, no further orders are required to be passed in this writ petition.

Accordingly, the writ petition is closed. However, there shall be no order as to costs.

As a sequel thereto, Miscellaneous Applications, if any, pending in this writ petition shall stand closed. ___________________ T. VINOD KUMAR, J Date: 13.12.2019 Isn
