HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.10090 of 2016 ORDER :

This Criminal Petition is filed under Section 482 of the Code of the Criminal Procedure, 1973, seeking to quash the proceedings in PRC No.23 of 2016 on the file of the Addl. Judl. I Class Magistrate, Bhongir, Nalgonda District. 2.

A charge sheet came to be filed against the petitioner/A.2 along with other accused for the offences punishable under Sections 120-B and 306 r/w 34 IPC. 3.

Though the present Criminal Petition is filed seeking quashing of entire proceedings against the petitioner, learned counsel for the petitioner restricts his prayer seeking dispensation of the presence of the petitioner before the trial Court on every date of adjournment.

The learned Public Prosecutor submits that since the identity of the petitioner is not in dispute, his presence in the above PRC may not be necessary on every date of adjournment.

Having regard to the facts and circumstances of the case, the personal appearance of the petitioner/A.2 in PRC No.23 of 2016 on the file of the Addl. Judl. I Class Magistrate, Bhongir, Nalgonda District, is hereby dispensed with while permitting him to mark his appearance through his counsel, except on the dates when his presence is specifically required by the said Court.

With the above direction, the Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
