HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.19321 OF 2002 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus declaring the action of the 2nd respondent in not considering the request of the petitioner in sending his license for proper verification at Additional Licensing Authority, Red Hills, Chennai and Additional Licensing Authority, Chennai (West) and not giving appointment to the post of driver grade II in Tirupati region, as illegal and arbitrary. 2.
It has been contended by the learned Counsel for the petitioner that the case of the petitioner was not considered for appointment to the post of driver as the respondents have expressed some doubt about the license possessed by the petitioner. Further, it has been contended by the learned Counsel for the petitioner that the respondents have referred the matter to the licensing authority, Chennai and the licensing authority has also given clearance, and in spite of the same, the respondents are not considering the case of the petitioner and that the petitioner also made a representation to the respondents on 27.7.2000, but the respondents have not considered his representation.

The learned Standing Counsel for the respondents contended that the petitioner may be directed to make a fresh representation and on such representation being made, the respondents shall consider and pass appropriate orders. 4.
This Court having considered the above submissions is of the view that the writ petition can be disposed of directing the petitioner to submit a fresh representation to the respondents duly enclosing the valid driving license.

Accordingly, the Writ Petition is disposed of directing the petitioner to submit a fresh representation to the respondents duly enclosing a valid driving license, within one week from the date of receipt of a copy of this order. On such representation being made, the respondents shall consider the same and pass appropriate orders in another four weeks thereafter. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
