THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SMT. JUSTI CE ANI S CI VI L REVI SI ON PETI TI ON No.5437 of 2016 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) This civil revision petition under Article 227 of the Constitution is sought to be maintained against the Award dated 10.08.2016 passed by the sole arbitrator in Arbitration Case No.84 of 2015. Pertinent to note, Section 34 of the Arbitration and Conciliation Act, 1996, provides a remedy to a party aggrieved by an arbitral Award who can seek setting aside of such an Award in the event the conditions stipulated therein are established. That apart, the power of judicial superintendence of this Court under Article 227 of the Constitution would not extend to a private arbitral tribunal.
Viewed from any angle, this civil revision is utterly misconceived and is not maintainable.
The civil revision petition is accordingly dismissed. This order shall however not preclude the petitioners from availing appropriate remedies available to them in accordance with law.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
