HON'BLE SRI JUSTICE T.VINOD KUMAR W.P.No.19767 of 2019 ORDER:

This Writ Petition is filed to declare the action of the respondents in not investigating into the Crime No.318 of 2019 of Kamareddy police station in a fair manner as being illegal and arbitrary and in violation of Rules under the SC/ST (POA) Act. 2.

Heard the learned counsel for thee petitioner as well as the learned Government Pleader for Home appearing for the respondent Nos.1 to 6.

Learned Government Pleader for Home appearing for respondent Nos.1 to 6, on written instructions dt.24-09-2019, a copy of which is placed on the file of this Court, would submit that on receiving the complaint from the petitioner on 27-08-2019, the 5th respondent authority got a discrete enquiry on the allegations leveled therein; that in the course of such investigation, as many as 14 witnesses were examined and their detailed statements were recorded; that on the basis of discrete enquiry and the statements of the witnesses recorded and the digital evidence which was collected during the investigation, it revealed that the complainant and the other witnesses did not visit the house of the accused and in-turn to help out their employer; that the complainant and other eye witnesses, as said, prepared a false complaint in order to settle and pressurize the accused

TVK,J W.P.No.19767 of 2019 and his brother from prosecuting the cases that have been filed by them. Based on such investigation and after obtaining permission from the Deputy Inspector General of Police, Nizamabad Ranze, Nizamabad District, vide C.No.C1/43/SC-ST/DIG/NR-NZB/2019 dt.07-09-2019, the complaint was closed as false after serving a notice to the complainant on 08-09-2019 and final report in the case stating the same to be false was filed on 09-09-2019 before the learned Judicial Magistrate of First Class, Kamareddy. 4.

Having regard to the said submission, since a final report has been filed before the Court concerned, it is open for the petitioner to avail remedies in accordance with law.

With the above observation, the Writ Petition is closed. No costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
