HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.10550 OF 2010 ORDER:

This writ petition was filed challenging the notice dated 09.11.2009 issued by the third respondent asking the petitioner to pay an amount of Rs.1,21,400/- towards deficit stamp duty on the instrument impounded and also requesting him to show cause why ten times penalty shall not be levied on the impounded instrument. Pursuant to the said notice, the petitioner submitted a representation dated 24.11.2009 raising his objections with regard to the deficit stamp duty and the proposed penalty and when no orders were passed, the present writ petition was filed. In the counter affidavit filed by the third respondent, it is stated that final order was passed on 17.05.2010 and though it was sent to the petitioner through registered post, it was returned by the petitioner. In view of passing of final orders, this writ petition has become infructuous and liberty is given to the petitioner to take appropriate proceedings in accordance with law.

The writ petition is accordingly dismissed as infructuous. Consequently, miscellaneous petitions, if any pending, shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 27.07.2017 pln
