Smt. Vishnumolakala Siva Kumari v. Smt. Panchumarthi Hima Bindu,
THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY Civil Revision Petition No.2885 of 2015 Dated 24th July, 2015 Between:
Smt.Vishnumolakala Siva Kumari
...Petitioner
And Smt.Panchumarthi Hima Bindu and others
...Respondents
Counsel for the petitioner: Sri Gade Venkateswara Rao Counsel for the respondents: ---- The Court made the following:
ORDER:
This civil revision petition is filed under Article 227 of the Constitution of India for a direction to the learned I Additional Senior Civil Judge, Guntur to dispose of O.S.No.762 of 2009 filed by the petitioner.
A perusal of the docket sheet of the lower Court shows that the trial was concluded on 02.12.2013 and the case has been coming up for arguments from 06.12.2013. Since then, the case was adjourned more than 40 times. From 28.04.2014, the case is being adjourned with the endorsement 'Call with IAs'. In my opinion, there is absolutely no justification for the lower Court in keeping the suit pending at the arguments stage for as long as 11⁄2 years. Therefore, the lower Court is directed to dispose of the suit along with IAs as expeditiously as possible and not later than two months from the date of receipt of a copy of this order.
Subject to the above direction, the civil revision petition is disposed of.
As a sequel to disposal of the civil revision petition, C.R.P.M.P.No.3832 of 2015 shall stand disposed of as infructuous. C.V.NAGARJUNA REDDY, J 24th July, 2015 VGB
