HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.19771 OF 2019 ORDER (ORAL) :

This Writ Petition is filed by the petitioner requesting to declare the inaction of respondent No.3 - Station House Officer, Shamirpet Police Station, Cyberabad, in pursuance of the representations of the petitioner dated 30.08.2019 and 05.09.2019 as being illegal and arbitrary and for a consequential direction to respondent No.3 to conduct investigation in Crime No.297 of 2019 by altering the section of law.

2. Heard Sri V. Venkata Mayur, learned counsel for the petitioner, and learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 3, and perused the material on record.

The learned Assistant Government Pleader for Home based on the written instructions dated 25.10.2019, a copy of which is placed before this Court, would submit that based on the complaint of the petitioner, respondent No.3 took up investigation into the matter, registered Crime No.297 of 2019 and as part of investigation, examined independent witnesses LWs.1 to 10, collected post-mortem examination report and also obtained opinion from the Assistant Professor, Department of Forensic Medicine, Gandhi Hospital on 22.08.2019. It is also submitted that investigation is completed and case will be finalised within a period of two (2) weeks.

4. In view of the aforesaid circumstances and since the investigation was already completed, at this stage, this Court sees no reason to doubt the course of investigation adopted by respondent No.3. If the petitioner has any grievance with regard to the course of investigation adopted by respondent No.3, it is always open to him to avail appropriate remedies available to him in accordance with law after filing a final report / charge sheet by respondent No.3 before the competent authority.

5. Accordingly, recording the submission made by the learned Assistant Government Pleader for Home on behalf of respondent No.6, the writ petition is disposed of. No order as to costs. As a sequel thereto, Miscellaneous Petitions, if any, pending in the Writ Petition stand closed.
