This writ petition is filed seeking Writ of Mandamus declaring the action of the respondent Nos.3 and 4 in trying to dispossess the petitioner from the property bearing Municipal No.11-1-204/1, Vidyuth Nagar, Kanteshwar, Nizamabad, without issuing any notice to the petitioner, as illegal and arbitrary and consequently direct the respondents not to dispossesses the petitioner from the above said property. The case of the petitioner is that he is the absolute owner and possessor of land admeasuring to an extent of 450 sq.yards bearing Municipal No.11-1-204/1, Vidyuth Nagar, Kanteshwar, Nizamabad, by virtue of patta certificate vide proceedings No.1039/2007 dated 23.12.2007. While so, the respondents 3 and 4 are trying to evict the petitioner without issuing prior notice him. Aggrieved by the same, the present writ petition is filed.
Heard the learned counsel for the petitioner. Sri R.A.Chary, learned Standing counsel for 3rd respondent submits that the action would be initiated against the petitioner after issuing necessary notice. Recording the submission of the learned Standing Counsel for 3rd respondent, this writ petition is disposed of directing the respondents not to evict the petitioner without following due process of law.
