This application A.S.M.P.No.3067 of 2016 has been filed stating that the appeal bas been abated as the respondents in the M.P. and the appellants in the main appeal died on 24th May, 2009 and 4th September, 2009.

An order passed in connected appeal A.S.No.299 of 2005 by this Court is also enclosed whereunder consequent on the death of the appellants, that appeal is also held to be abated. In this A.S.M.P. also, an opportunity was given to the appellants to appear and file counters etc., on the contents of this application. There is no representation for the appellants despite opportunity being given.

It is made clear that there is nothing to say in the matter. Hence, this appeal is dismissed as abated. No costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
