THE HON'BLE SRI JUSTICE S.V.BHATT W.P. No.5510 of 2017 ORDER:

Mr.Srinivasa Rao argued the writ petition for admission and also for interim relief for considerable length of time.

After taking note of the method of petitioner in claiming the title, exclusive possession on small extents of house plots and also preventive relief against respondents herein, submits that it is desirable that the petitioners work out their grievances before the competent civil court where issues in fact, law, identity of property, etc., are examined.

Learned counsel for petitioner seeks leave of the Court to grant liberty to petitioners to work out their remedies before the competent civil court. Learned counsel chooses not to make submissions on merits, for, in the event the petitioners are willing to work out their remedies before the competent civil court, the findings, now the Court considers may come in their way.

In view of the above circumstances, the writ petition is dismissed by granting liberty to petitioners

to work out their remedies against the respondents before the competent civil court. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
