O R D E R:- This writ petition is filed for the following substantive relief:
"...to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of respondent Nos.1 to in not releasing compensation/exgratia for the land acquired in an extent of Ac.5.00 cents in Sy.No.367/1 situated in Koduru village, Anakapalli Mandal, Visakhapatnam District, as illegal and arbitrary and consequently direct them to release compensation/exgratia to the petitioner for the acquired land" The learned counsel for the petitioner has submitted that the 4th respondent - Tahsildar, without paying compensation / exgratia, arbitrarily issued notice dated 14.07.2015 proposing to acquire the petitioner's land for public purpose. He has further submitted that even though the petitioner made a representation dated 24.12.2015 to the 2nd respondent requesting him to pay ex-gratia for acquiring her land, so far, the same has not been considered.
Keeping in view the averments made in the writ affidavit and the submissions made by the learned
counsel for the petitioner, this Court deems it appropriate to dispose of the writ petition with the following direction: "The 2nd respondent - Special Deputy Collector (Land Acquisition) is directed to consider the representation dated 24.12.2015 said to have been made by the petitioner and pass appropriate orders thereon in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. It is made clear that if the petitioner is still aggrieved by the action or inaction of the respondent, she may seek appropriate remedy as may be available to her under law." With the above direction, the writ petition is disposed of. No order as to costs.
As a sequel to the disposal of the writ petition, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
