THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7370 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime No.106 of 2023, on the file of Jogipet Police Station, Sanga Reddy District, registered for the offence under Section 363 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

The Jogipet Police filed charge sheet against this petitioner stating that he had committed offence of rape. The victim girl is a minor girl. According to the case of the Police, the victim and the petitioner were messaging each other on 'Instagram' App. They became friendly and participated in sexual intercourse.

On multiple occasions, there was sexual intercourse between the victim girl and this petitioner. On 17.06.2023, while the

victim girl and the petitioner were on a video call, the mother of the victim girl scolded her. The victim girl went with the petitioner and stayed in the house of petitioner's brother. There also they had sexual intercourse. 4.

Learned Additional Public Prosecutor would submit that investigation is complete and charge sheet is already filed.

As seen from the record, the petitioner is aged 18 years and studying Inter II year. Since investigation is complete, this Court deems it appropriate to grant regular bail to the petitioner subject to following conditions:

i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate, Andole at Jogipet, Sanga Redy District.

ii) The petitioner shall not in any manner try to contract either the victim girl or her relatives,

failing which, the bail granted is liable to be cancelled.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
