HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.29690 OF 2017 ORDER :

This writ petition is filed seeking writ of mandamus declaring the action of the respondents in not promoting the petitioner to the post of Assistant Director of Town and Country Planning from the post of Town Planning Officer without reference to the Charge Memo G.O.Rt.No.70, MA & UD (Vig.II) Department, dated 10.09.2014, as illegal and arbitrary.

It is the case of the petitioner that he is presently working as Town Planning Officer, Mancherial Municipality, Mancherial, Mancherial District. He was issued impugned charge Memo G.O.Rt.No.70, MA & UD (Vig.II) Department dated 10.09.2014. Though charge memo was issued on 10.09.2014, disciplinary proceedings are not concluded and that due to pendency of disciplinary proceedings, respondents are not considering his case for promotion as Assistant Director of Town and Country Planning. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Services.

Learned counsel for the petitioner submits that the Government had issued guidelines under G.O. Ms.No.257, dated 10.06.1999 and his case is squarely falls within the guidelines under aforesaid GO.

Without expressing any opinion on merits of the case, as and when competent authority takes decision for promotion, case of the petitioner may be considered for promotion to the post of Assistant Director of Town and Country Planning in terms of guidelines issued under G.O.Ms.No.257, dated 10.06.1999, in accordance with law.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition shall stand closed.
