THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CIVIL REVISION PETITION No.68 of 2017 ORDER:

Heard learned counsel for the petitioner Sri C.Prakash Reddy and learned counsel for the respondents Sri Maheswara Rao Kunchem and with their consent, the C.R.P. is disposed of at the admission stage.

The C.R.P. is filed by the J.Dr. No.1 aggrieved by the order dated 29-11-2016 in E.P.No.88 of 2014 in A.R.No.224 of 2013 on the file of Principal District Judge, Kadapa whereunder the executing court ordered attachment of the petition schedule property for sale and realization of the fruits of the award in A.R.No.224 of 2013. When the C.R.P. came up before this court for hearing, both the learned counsel would submit that the balance E.P.amount payable by the J.Dr. to D.Hr. is Rs.17,74,098/- and the first J.Dr. has agreed to pay the said amount installment-wise @ Rs.2,00,000/- on or before 5th of every month commencing from 5-2-2017 till the entire amount of Rs.17,74,098/- is discharged and D.Hr. is agreed for this course. It is further submitted by the counsel that in the event of failure by the petitioner/J.Dr. to pay the said installments, the D.Hr. will be at liberty to proceed with the execution.

In view of the above submission made by both the counsel, recording the aforesaid submission, this C.R.P. is closed.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
