HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.5750 of 2019 ORDER :
This Criminal Petition under Section 438 of Cr.P.C. is filed by the petitioner/A6, seeking anticipatory bail in furtherance of executing NBW in S.C.No.10 of 2016 on the file of the IV Addl. Chief Metropolitan Magistrate, Hyderabad. 2.
It is submitted by the learned counsel for the petitioner that on 30.04.2011 about 100 students started cooking Beef Flesh at EFLU Camps as a part of Beef festival and while it is in process, around 200 students of EFLU under the leadership of Mr.Janardhan and others have formed into a group and on provocation of Hostel host, Venkat Redy and Prakash Kona Reddy, have attacked the de facto complainants and other students and spoiled the beef curry and abused the de facto complainants jointly in the name of their caste and they have passed urinals on the food and insulted their food culture. It is further submitted that the petitioner was residing in the same hostel of the other accused, which is situated within the EFLU campus in the year 2011 and subsequently, the petitioner left the camps in the year 2012.
The petitioner has been falsely implicated in the above crime. The petitioner is innocent person and he is no way concerned with the above crime. The petitioner was not arrayed as accused in the FIR, but at the time of filing charge sheet, his name was arrayed as A6 and pursuant to the same, NBW was issued against him on 26.08.2015.
petitioner was neither intimated the proceedings nor issued any notice in connection with the above case. The petitioner is a student and law abiding citizen coming from a reputed family. The petitioner has reasonable apprehension that he may be arrested on false accusation of having alleged committed the offence.

Learned Additional Public Prosecutor representing the State opposed the bail application.
4. Having regard to the nature of allegations leveled against the petitioner, I am not inclined to grant anticipatory bail to the petitioner.

Accordingly, the Criminal Petition is dismissed. However, the petitioner shall move an application before the concerned Court for re-calling of N.B.W. and the same may be considered in accordance with law on the same day.
